Deposition

Deposition is taking of testimony under oath of a witness, either oral or written (rare) questions, taken under oath by one of the parties to a case. Depositions are usually taken in one of the parties lawyer’s offices. An exact transcript of the deposition is made for later use such as impeachment or to refresh memory.

The deponent is the person who is deposed. Depositions are usually taken of the parties, plaintiff(s) and defendant(s), in personal injury cases. Depositions may also be taken from anyone else who has information that is relevant to the case such as a witness or health care provider.
