Summary Judgment

Summary judgment is procedural means which resolves a dispute without trial. When there is no genuine issue of fact or the facts are not disputed a plaintiff or defendant can move or ask the court to grant summary judgment and decide the issue or dispute as a matter of law. A motion for summary judgment may involve an entire claim, part of a claim or defense. The Court can consider anything made part of the record in the case such as the pleadings and affidavits.
